TACTICAL OPERATIONS TO NEUTRALIZE MEDIA COUNTERACTION TO THE INVESTIGATION

Abstract

The problem of counteraction to the investigation of criminal offenses has recently become particularly urgent and acute due to the growing scale of organized forms of criminal activity. More and more often, criminals seriously oppose the detection, disclosure and investigation, as well as the trial of criminal offenses, they hide, mask, falsify reliable forensically significant information and its sources. The media are sometimes used for this purpose.

Working in places of armed conflicts, terrorist acts, and when liquidating dangerous criminally unlawful groups, a journalist (a member of a creative group) is obliged not to disclose the plans of special units, information that is a secret of the pre-trial investigation, not to allow actual propaganda of the actions of terrorists and other criminally unlawful groups, their actions and statements specially inspired for the media, not to act as an arbitrator, not to interfere in the incident, not to create artificial psychological tension in society. However, modern media do not always adhere to such prescriptions of the current legislation of Ukraine.

It has been established that modern media in Ukrainian society is an extremely important social institution, the importance of which is constantly growing in the processes of mass communication and the implementation of flexible forms of informational social control. The functions and place of the media in society have been determined as a means of informing the public and as a way of society’s control over the activities of the authorities. Media have become an indicator of new thinking, they form a new type of social consciousness.

The purpose of this study is to determine the components of tactical operations to neutralize the media’s resistance to the investigation and to develop forensic recommendations for conducting such tactical means.

The authors proposed specific measures, components of a tactical operation, which can be implemented comprehensively, aimed at achieving a specific goal, taking into account the factors that caused the investigative situation that arose.
