KEY THREATS TO THE PHYSICAL AVAILABILITY AND QUALITY OF FOOD IN THE CONDITIONS OF MARITAL STATE

Abstract

The article describes the results of a study of the legal regulation of the economic mechanism of state food security management in terms of physical accessibility and ensuring the quality of food in order to identify problem areas and develop areas for its improvement. In conditions of martial law, special requirements arise for regulatory and legal regulation, taking into account all the negative consequences of hostilities, missile attacks, mining of a significant part of the territory, blocking of logistical facilities and routes. At the same time, the need to provide the domestic market with food and continue foreign economic activity in special conditions requires effective innovative solutions from the authorities.

The shortcomings of the legislative provision of food security and by-laws adopted for the period from the beginning of the full-scale invasion on February 24, 2022, which are in force at the time of the article’s publication, are considered. Based on the analysis, conclusions are drawn and proposals are made to improve the state regulatory and legal regulation of physical accessibility and quality of food in conditions of martial law. The previously introduced concept of “economic Ukrainianocentrism” is detailed.

The research methodology is monographic, abstract-logical, hypothetical methods, SWOT analysis and structural-functional analysis method. The research hypothesis is based on the assumption that by identifying and classifying the regulatory and legal support for the functioning of food supply chains under martial law, it is possible to make food safer and develop the physical availability of food for the domestic consumer. And by reviewing and updating Ukrainian legislation in order to fully comply with international standards of quality and food safety (EU, FAO, WHO, Codex Alimentarius, ISO 22000, OIML, IPPC, ICMSF), it is possible to provide a high-quality legal basis for the implementation of international standards of quality and safety in the production, storage, transportation and sale of Ukrainian products, both on the domestic market and on the world market. The theoretical significance and novelty of the article lies in the analysis of the current laws of Ukraine and by-laws, specific author’s proposals for improving the regulatory framework in terms of food security in Ukraine.
